Terms and conditions of sale

1. Scope

These terms and conditions apply to every distance sale concluded between La Vitrine Locale SRL, hereinafter “the seller”, and a customer acting for private purposes, hereinafter “the consumer”.

The applicable version is the one published on this site at the time of the order. We invite you to keep or print a copy.

2. Products

The seller sells caramelised almonds (“Apéro Almonds”), packaged in 75 g sachets and sold in packs of 12 sachets. The pack is the unit of sale: individual sachets are not sold separately on this site.

The composition, allergens and nutritional values are shown on the product page and on the packaging. The labelling of the sachet delivered prevails. Photographs are illustrative and not contractually binding.

3. Prices

The price is 48,00 € per pack of 12 sachets, Belgian VAT included, i.e. 4,00 € per sachet.

The minimum order is one pack. Quantities are added in whole packs, up to 20 packs per order (240 sachets).

Shipping costs are added to the price of the goods and are shown before the order is confirmed. The total amount due is displayed before payment.

The seller may change prices at any time; the applicable price is the one displayed at the time of the order.

4. Ordering

An order goes through four steps:

• adding the product to the cart and choosing the number of packs;
• entering your details and delivery address;
• accepting these terms and conditions;
• paying online.

4 bis. Formation of the contract

The contract is concluded when the payment is confirmed by the payment provider. A summary email is then sent to the consumer.

The seller reserves the right to refuse or cancel an order in the event of unavailability, a manifest pricing error or suspected fraud. In such a case, any amounts already paid are refunded in full.

5. Payment

Payment is made online through Mollie B.V.: Bancontact, bank card or transfer, depending on the methods offered at the time of the order.

No payment details pass through this site or are stored on it: they are entered on the secure pages of the payment provider.

An order is only prepared once payment has actually been confirmed.

6. Delivery

Deliveries are made within Belgium only.

Shipping costs are 5,95 € per order. They are free from 100,00 € of goods — that is 3 packs — shipping costs themselves not being counted in that total.

Delivery is carried out by a professional carrier to the address given by the consumer.

Unless stated otherwise, the order is delivered no later than 30 days after the contract is concluded. In the event of delay, the consumer may set a reasonable additional period and, failing delivery, terminate the order and obtain a refund of the amounts paid.

An incomplete or incorrect address may cause a delay or the return of the parcel; the cost of a second dispatch is then borne by the consumer.

The risk of loss or damage passes to the consumer when they take physical possession of the parcel.

7. Right of withdrawal

The consumer has 14 calendar days from receipt of the parcel to withdraw, without having to give a reason and without penalty (Article VI.47 of the Code of Economic Law).

To exercise this right, simply send an unambiguous statement before the deadline to pierre@lavitrinelocale.be, or use the model form reproduced in the annex.

The products must be returned within 14 days of that notification, to Avenue Robert Schuman 51/D23, 1400 Nivelles, in their intact original packaging. Return costs are borne by the consumer.

The seller will refund all payments received, including the cost of standard outbound delivery, within 14 days of receiving the withdrawal statement — where applicable after receiving the returned products — using the same means of payment as the one used for the order.

8. Limit to the right of withdrawal

In accordance with Article VI.53 of the Code of Economic Law, the right of withdrawal cannot be exercised on sealed foodstuffs whose sachet has been opened after delivery: for reasons of hygiene and food safety, these products cannot be taken back.

A sachet that has remained sealed may, however, be returned under the conditions of Article 7.

9. Conformity and warranty

The seller must deliver a product that conforms to the order. The consumer benefits from the statutory warranty of conformity provided by Belgian law.

As these are foodstuffs, the best-before date is shown on the sachet. Any defect found (damaged parcel, non-conforming product) should be reported as soon as possible, with a photograph if available, so that a replacement or refund can be arranged quickly.

Belgian law applies to the contract.

11. Personal data

The data provided when ordering is processed in accordance with the privacy policy accessible from the footer of this site.

12. Language of these terms

This English version is provided for convenience. In the event of any discrepancy, the French and Dutch versions prevail.

Complete and return this form only if you wish to withdraw. Using this form is not compulsory: any unambiguous statement is sufficient.
